Welcome to PopPayAI. Please read these Terms of Service (“Terms”) carefully before using our main website (poppayai.com) and our cloud platform (cloud.poppayai.com), collectively referred to as the “Service”.

By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you may not access or use our services.

1. Description of Service

PopPayAI provides artificial intelligence-driven payment processing, analytics, and automation software via poppayai.com. Our cloud platform, cloud.poppayai.com, offers cloud-hosted dashboards, API access, integration tools, and data storage solutions (collectively, “Cloud Services”).

2. Eligibility and Account Registration

  • Age Requirement: You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
  • Account Security: When you create an account on cloud.poppayai.com, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • Corporate Authority: If you are using the Service on behalf of a company or entity, you represent and warrant that you have the authority to bind that entity to these Terms.

3. Acceptable Use Policy

You agree not to misuse the Service. Specifically, you will not:

  • Use the Service for any illegal or unauthorized purpose, including violating financial regulations or anti-money laundering laws.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the servers or networks hosting cloud.poppayai.com.
  • Reverse engineer, decompile, or extract the source code of PopPayAI’s proprietary AI models or software.
  • Deploy any automated bots, scrapers, or spiders that place an unreasonable load on our cloud infrastructure.
  • Use the Service to process, store, or transmit malicious code, malware, or viruses.

4. Fees, Billing, and Subscription Plans

  • Subscription Models: Certain features of the Cloud Services are billed on a subscription basis (“Plans”). You will be billed in advance on a recurring, periodic cycle (monthly or annually) depending on the plan you select.
  • Payment and Taxes: You agree to provide valid billing information. All fees are exclusive of applicable taxes, which will be charged when required by law.
  • Price Changes: PopPayAI reserves the right to modify subscription fees. We will provide at least 30 days’ notice before any price changes take effect.
  • Refund Policy: Except as required by law or explicitly stated in a specific plan, all purchases and subscription fees are non-refundable.

5. Data Privacy, Ownership, and Security

  • Your Data: You retain all rights, title, and interest in the data, text, or files you upload, process, or store on cloud.poppayai.com (“User Data”). By uploading User Data, you grant PopPayAI a worldwide, limited license to host, transmit, and process your data solely to provide the Service to you.
  • AI Models: Using the service does not grant you ownership of any underlying AI models, weights, or algorithms generated by PopPayAI.
  • Privacy Policy: Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal and financial information.

6. Service Availability and Service Level Agreement (SLA)

  • Uptime Target: While we strive for 99.9% uptime on cloud.poppayai.com, the Cloud Services are provided on an “as-is” and “as-available” basis.
  • Maintenance: We may occasionally require scheduled downtime for maintenance or upgrades. We will attempt to notify users in advance of any major disruptions.
  • Force Majeure: PopPayAI is not liable for service interruptions caused by factors beyond our reasonable control, including cloud infrastructure provider outages (e.g., AWS, Google Cloud), cyberattacks, or internet-wide routing failures.

7. Intellectual Property Rights

The Service, including its original content, features, functionality, logos, user interfaces, and AI frameworks, are and will remain the exclusive property of PopPayAI and its licensors. You may not use our branding, trademarks, or proprietary layouts without our express written consent.

8. Termination

  • By You: You can cancel your cloud account and terminate these Terms at any time by navigating to your account settings on cloud.poppayai.com.
  • By Us: We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms, engage in fraudulent behavior, or fail to pay outstanding subscription fees.
  • Effect of Termination: Upon termination, your right to use the Cloud Services ceases immediately. You are responsible for exporting your User Data prior to termination.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PopPayAI, its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, use, or goodwill—resulting from:

  1. Your access to or inability to access cloud.poppayai.com.
  2. Any unauthorized access, use, or alteration of your transmissions or data.
  3. Errors, inaccuracies, or hallucinations generated by our AI tools.

10. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Governing Law and Dispute Resolution
